1. Who we are and what these Terms cover

Channel 16 ("CH-16", the "Service") is a voice-based pilotage examination trainer provided by FLEXSELL INTERNATIONAL W.L.L, CR 149517-1, Hidd, Kingdom of Bahrain ("FlexSell", "we"). These Terms govern your use of the Channel 16 iOS app, Android app and web app at ch-16.com. By signing in you accept these Terms and our Privacy Policy. If you use the Service on behalf of a training organisation, that organisation's agreement with FlexSell also applies and prevails where the two conflict.

2. Accounts

Accounts are created by your organisation's administrator. You must keep your password confidential, use only your own account and tell us or your administrator immediately if you suspect unauthorised use. You must be at least 18 years old. We may suspend or close an account that breaches these Terms or that your organisation asks us to close.

3. The examination service

The Service asks you questions aloud, listens to your answers and scores them with an AI examiner against a rubric written by your organisation. You agree that:

• your voice is streamed to our servers and to our AI provider during a session and that each session is recorded and transcribed, as described in the Privacy Policy;
• scores are produced automatically and are made available to your organisation's administrators, who may review, confirm or override them;
• the Service is a training and assessment aid. It is not a certificate of competency, a pilotage licence or a substitute for the statutory examinations of any port authority, flag state or maritime administration, and it does not replace official publications, charts, notices or the judgement of a qualified pilot or master;
• questions and reference material are supplied by your organisation and may contain errors. Where two sources disagree, the examiner surfaces both; you should verify operational values against the official source before relying on them at sea.

4. Acceptable use

You must not: share your account or sit an exam for another person; attempt to extract, copy or redistribute the question bank, rubrics or recordings; reverse-engineer, probe or overload the Service; upload unlawful, offensive or infringing content (including in a profile picture); or use the Service to build a competing product. Automated access other than through the app is prohibited.

5. Fair usage and availability

Each account has a daily usage allowance set by your organisation. The Service may pause sessions when the allowance is reached. The Service is hosted on infrastructure that sleeps when idle; the first session after a quiet period may take about a minute to become available. We aim for high availability but do not guarantee uninterrupted service and may suspend it for maintenance, security or legal reasons.

6. Intellectual property

The Service, its software, design, examiner prompts and FlexSell content are owned by FlexSell or its licensors. Question banks, rubrics and images belong to the organisation that uploaded them. Your session recordings and transcripts are your personal data and your organisation's assessment records; you grant FlexSell the licence needed to store, process and display them to provide the Service. Nothing in these Terms transfers ownership of any content.

7. Third-party services

The Service relies on third-party processors (Amazon Web Services, OpenAI, Sentry) listed in the Privacy Policy. Their availability and terms are outside our control. App distribution is governed additionally by the Apple App Store and Google Play terms that apply to you.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, FlexSell disclaims all warranties, express or implied, including fitness for a particular purpose and accuracy of AI-generated scores or explanations. Speech recognition and AI reasoning can misunderstand or err; always confirm important results with a human examiner.

9. Limitation of liability

To the fullest extent permitted by law, FlexSell is not liable for indirect, incidental, special or consequential loss, loss of data, loss of certification or examination outcomes, or any decision or action taken at sea or ashore in reliance on the Service. Our total liability to you for all claims relating to the Service is limited to the amount your organisation paid FlexSell for your use of the Service in the twelve months before the claim, or BHD 100 if nothing was paid. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Termination

You may stop using the Service at any time and ask your administrator to close your account. We may suspend or terminate access for breach of these Terms, at your organisation's request or if the Service is discontinued. Sections 6, 8, 9 and 12 survive termination.

11. Changes

We may update these Terms. The current version is always at ch-16.com/terms-of-use.html with its version date. Continued use after a change means you accept the updated Terms; material changes will be announced in the app or to your organisation in advance.

12. Governing law

These Terms are governed by the laws of the Kingdom of Bahrain. Disputes are subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain, without prejudice to any mandatory consumer rights you have in your country of residence.
